Client Information Rental Car Coverage • Medical Expenses

What happens when you have been in an Accident, and you discover your Insurance does not Protect you as you expected it should?

Vehicle Insurance:

Most Policy-holders rarely review their Insurance Policies until an Accident makes it necessary. Even then it becomes apparent that as a rule, Insurance Policies are written by Lawyers, for Lawyers. You may need to retain your Attorney to read your Policy and advise you of your Legal Rights. Usually smaller insurance claims are not contentious, and it is not necessary to retain an Attorney. However, for large insurance claims, use of a Lawyer may be highly cost-effective.

Remember, one can not rely on the at-fault party's Insurance to cover all expenses. Certain costs may arise, such as Medical Expenses, which may be covered immediately under your own Insurance Policy. Even when a Collision is the fault of someone else, that person may not have insurance or delays in the Claim Process may result in significant out of pocket expenses until the claim is settled. It is advisable to review your own policy immediately in order to minimize immediate, unnecessary, out of pocket expense.

Rental Car Coverage:

If my Vehicle is damaged, how do I get around?

Many Insurance Companies will offer Coverage to pay for a Rental Car while their insured is having their Vehicle repaired. Often, consumers will ask their insurance agent to provide them with Rental Car Coverage, only to find out, in their time of need, that the standard coverage is too low to cover the expenses of a much needed Rental Vehicle. Many Policies will set the coverage at a specified sum, such as $15.00 per day; less then half of what it costs to rent a car. Check your Policy to insure you have adequate Coverage or that you are not paying too much for insufficient Coverage.

Medical Expenses:

Who pays for my Medical Expenses?

Typically, an Attorney will attempt to satisfy all Medical Expenses, resulting from your Auto Accident, after a recovery has been made. Keep in mind, sending medical bills to your Attorney does not insure payment. Also, it is important to note that any Medical Provider is not interested in how you were injured, only in how you will pay. Ultimately, you are responsible for all Medical Bills. If you have "Medical Protection Coverage" within your own Automobile Insurance Policy, advise your Attorney immediately. If you choose not to use an Attorney, notify your Insurance Company immediately so that they can commence with adequate payments. Keep in mind that there is a limitation as to how much your Insurance will cover. Also, if you have Health Insurance, be sure to advise the treating facility of your health provider, group number, policy number, and anything else they may require. Finally, keep in mind, if you do recover from the at fault party, your Health Insurance provider may be entitled to Subrogation. This means, if they have paid for medical treatment, as a result of the Auto Accident, and you have recovered from the at fault party, they may be entitled to be reimbursed, from you, for the expenses they have paid for on your behalf.
